En cons\u00e9quence, Zewu avait engag\u00e9 une action p\u00e9nale contre Zesa pour non respect de l&rsquo;accord. Le procureur g\u00e9n\u00e9ral a estim\u00e9 que Zesa avait d\u00e9lib\u00e9r\u00e9ment refus\u00e9 de donner aux travailleurs et travailleuses le montant qui leur \u00e9tait d\u00fb, et que l&rsquo;entreprise avait commis une infraction en contrevenant \u00e0 la loi sur le travail.<\/p><p>Le magistrat a d\u00e9clar\u00e9 dans son jugement: &ldquo;Nous avons trouv\u00e9 Zesa coupable de non respect du SI 50 (enregistrement de la convention collective) qui oblige \u00e0 verser l&rsquo;augmentation salariale de 2012. Les faits retenus contre Zesa sont accablants. Quand les n\u00e9gociations sur la convention collective ont eu lieu en 2012, Zesa \u00e9tait pr\u00e9sente \u00e0 la table des n\u00e9gociations et donc pleinement inform\u00e9e de la cr\u00e9ation du SI 50. Pour cela, et pour tous les autres faits expos\u00e9s devant l&rsquo;honorable tribunal, l&rsquo;\u00c9tat a trouv\u00e9 que ZESA \u00e9tait indubitablement coupable&rdquo;.<\/p><p>Le tribunal a ordonn\u00e9 \u00e0 Zesa de payer une amende de 400 USD, de respecter l&rsquo;accord et de restituer les sommes dues, en demandant \u00e0 Zesa de verser aux travailleurs et travailleuses 60 millions d&rsquo;USD pour les retards salariaux, faute de quoi il y aurait saisie sur les biens.<\/p><p>Cette d\u00e9cision de justice a provoqu\u00e9 des sc\u00e8nes de r\u00e9jouissances parmi les 3.000 salari\u00e9s de Zesa. La pr\u00e9sidente du Zewu, Angeline Chitambo, a d\u00e9clar\u00e9 dans un commentaire sur le jugement &ldquo;que cela donne une grande le\u00e7on aux employeurs qui ont surcharg\u00e9 de travail leurs salari\u00e9s et les ont sous-pay\u00e9s&hellip; et que justice a finalement pr\u00e9valu sur les forces du mal&rdquo;.&nbsp; &nbsp;<\/p><p>Chitambo avait \u00e9t\u00e9 <a href=\"http:\/\/www.industriall-union.org\/fr\/la-presidente-du-zewu-parmi-les-135-travailleurs-suspendus-chez-zesa\">injustement mise \u00e0 pied<\/a> l&rsquo;ann\u00e9e derni\u00e8re par Zesa pour avoir, selon les dires, incit\u00e9 les travailleurs et travailleuses \u00e0 se mettre en gr\u00e8ve pour non respect de la convention collective.
