En r\u00e9ponse, le syndicat a poursuivi l&rsquo;employeur au tribunal pour avoir refus\u00e9 de le reconna\u00eetre et pour ne pas se conformer \u00e0 ses &ldquo;devoirs et obligations en mati\u00e8re de n\u00e9gociation collective&rdquo;.<\/p><p>Au d\u00e9but du mois, l&rsquo;entreprise avait insist\u00e9 sur la tenue d&rsquo;un scrutin sous l&rsquo;\u00e9gide de la Commission de Conciliation, M\u00e9diation et Arbitrage pour d\u00e9terminer le soutien au syndicat parmi les travailleurs. L&rsquo;ensemble d&rsquo;entre eux, \u00e0 l&rsquo;exception d&rsquo;un seul, a vot\u00e9 en faveur du syndicat, envoyant ainsi un message tr\u00e8s clair quant \u00e0 la volont\u00e9 de s&rsquo;organiser syndicalement.<\/p><blockquote><p>Bien que l&rsquo;entreprise pr\u00e9tend garantir des pratiques de travail \u00e9quitables, elle figure au nombre des pires employeurs du secteur du textile et du v\u00eatement. Voulant \u00e0 tout prix tenir le syndicat \u00e0 l&rsquo;\u00e9cart, elle menace parfois de fermer l&rsquo;usine si les travailleurs et travailleuses ne d\u00e9missionnent pas du syndicat,<\/p><\/blockquote><p>indique Wander Mkhonza, Secr\u00e9taire g\u00e9n\u00e9ral de l&rsquo;ATUSWA.<\/p><blockquote><p>Les travailleurs et travailleuses sont tr\u00e8s clairs&nbsp;: il leur faut un syndicat et Fashion International doit leur accorder leurs droits \u00e0 la syndicalisation et \u00e0 la n\u00e9gociation collective et reconna\u00eetre l&rsquo;ATUSWA en tant que partenaire social.<\/p><\/blockquote><p>L&rsquo;entreprise se compla\u00eet \u00e9galement dans des pratiques d\u00e9loyales qui affectent n\u00e9gativement la sant\u00e9 et la s\u00e9curit\u00e9 des travailleurs et travailleuses. Ainsi, les salari\u00e9s malades sont forc\u00e9s \u00e0 se pr\u00e9senter au travail et, apr\u00e8s la visite d&rsquo;un m\u00e9decin un salari\u00e9 doit se pr\u00e9senter au travail dans les quatre heures maximum. \u00c0 d\u00e9faut, une action disciplinaire s&rsquo;ensuit souvent.<\/p><p>Il est demand\u00e9 aux travailleurs et travailleuses d&rsquo;amener leurs enfants malades sur leur lieu de travail pour obtenir la permission de s&rsquo;absenter pour les emmener \u00e0 l&rsquo;h\u00f4pital. Parfois, cette permission n&rsquo;arrive jamais ou elle est donn\u00e9e trop tard par rapport aux horaires de l&rsquo;h\u00f4pital. L&rsquo;employeur a \u00e9galement la f\u00e2cheuse r\u00e9putation de refuser de verser des cong\u00e9s de maladie au-del\u00e0 de deux journ\u00e9es. R\u00e9duire ainsi les jours de convalescence est courant et force les travailleurs et travailleurs encore souffrants \u00e0 se rendre au travail.<\/p><p>De plus, les travailleurs et travailleuses sont oblig\u00e9s de travailler le samedi, qui n&rsquo;est pourtant pas un jour ouvrable.
