{"id":148006,"date":"2019-02-26T14:33:25","date_gmt":"2019-02-26T14:33:25","guid":{"rendered":"https:\/\/admin.industriall-union.org\/philippines-la-loi-sur-l-augmentation-de-la-duree-des-conges-de-maternite-adoptee\/"},"modified":"2025-02-03T20:29:03","modified_gmt":"2025-02-03T20:29:03","slug":"philippines-la-loi-sur-l-augmentation-de-la-duree-des-conges-de-maternite-adoptee","status":"publish","type":"article","link":"https:\/\/admin.industriall-union.org\/fr\/philippines-la-loi-sur-l-augmentation-de-la-duree-des-conges-de-maternite-adoptee\/","title":{"rendered":"Philippines: la loi sur l\u2019augmentation de la dur\u00e9e des cong\u00e9s de maternit\u00e9 adopt\u00e9e"},"content":{"rendered":"<p>Les travailleuses et les syndicats font la f\u00eate apr\u00e8s que le Pr\u00e9sident des Philippines ait donn\u00e9 l&rsquo;impulsion finale, le 21 f\u00e9vrier, au projet de loi du S\u00e9nat prolongeant la dur\u00e9e du cong\u00e9 de maternit\u00e9 dans le pays.<\/p><p><a href=\"http:\/\/www.industriall-union.org\/fr\/victoire-aux-philippines-qui-adoptent-une-legislation-etendant-le-conge-de-maternite\">La nouvelle loi<\/a> accro\u00eet la dur\u00e9e de l&rsquo;actuel cong\u00e9 de maternit\u00e9 pay\u00e9 de 60 jours pour un accouchement normal et de 78 jours pour une c\u00e9sarienne \u00e0 105 jours pour les travailleuses dans les secteurs public et priv\u00e9, y compris pour les femmes travaillant dans l&rsquo;\u00e9conomie parall\u00e8le, quel que soit l&rsquo;\u00e9tat civil ou la l\u00e9gitimit\u00e9 de l&rsquo;enfant. La loi autorise jusqu&rsquo;\u00e0 sept jours de cong\u00e9 parental au p\u00e8re de l&rsquo;enfant.<\/p><blockquote><p>Cette loi a \u00e9t\u00e9 adopt\u00e9e gr\u00e2ce aux efforts des dirigeantes et dirigeants d&rsquo;IndustriALL aux Philippines, ainsi que des syndicats alli\u00e9s, de l\u00e9gislateurs, des d\u00e9fenseurs des droits de la femme et d&rsquo;autres partisans,<\/p><\/blockquote><p>a indiqu\u00e9 Eva Arcos, vice-pr\u00e9sidente au niveau national des Syndicats associ\u00e9s (ALU) et copr\u00e9sidente du Comit\u00e9 des femmes d&rsquo;IndustriALL.<\/p><blockquote><p>En plus d&rsquo;\u00eatre tr\u00e8s bonne pour la sant\u00e9 des m\u00e8res et des nouveau-n\u00e9s, cette loi prot\u00e9gera les emplois et garantira les revenus des travailleuses durant leur cong\u00e9 maternit\u00e9.<\/p><\/blockquote><p>La loi porte sur la diff\u00e9rence de salaire entre le salaire mensuel courant ou moyen et le paiement int\u00e9gral de l&rsquo;allocation de maternit\u00e9. Des exceptions, comme les microentreprises et les \u00e9tablissements de vente au d\u00e9tail et de service employant moins de dix travailleurs, sont subordonn\u00e9es \u00e0 la pr\u00e9sentation annuelle des motifs qui justifient une exemption.<\/p><p>Le non-respect de la loi est passible d&rsquo;une amende allant de 20 000,00 \u00e0 200 000,00 P (soit de 385 US$ \u00e0 3 850 US$) ainsi que de six \u00e0 douze ans de prison.<\/p><p>La Pr\u00e9sidente du Comit\u00e9 des femmes d&rsquo;IndustriALL pour les Philippines (IPWC), Susanne Dejon, a d\u00e9clar\u00e9:<\/p><blockquote><p>La nouvelle loi prot\u00e8ge les travailleuses et leur sant\u00e9. Il s&rsquo;agit d&rsquo;une grande victoire pour tous les travailleurs aux Philippines.<\/p><\/blockquote><p>Asuncion Binos de Pinagisang Tinig, \u00e0 Lakas ng Anakpawis (PIGLAS), et ancienne pr\u00e9sidente d&rsquo;IPWC, a not\u00e9:<\/p><blockquote><p>La loi sur la prolongation de la dur\u00e9e du cong\u00e9 de maternit\u00e9 prouve que les choses peuvent s&rsquo;am\u00e9liorer.
