Zulkarnain, dirigeant syndical, PT Schneider Electric a chang\u00e9 son poste pour un autre qui ne correspond pas \u00e0 ses comp\u00e9tences et \u00e0 son exp\u00e9rience professionnelle. Bien qu&rsquo;il a \u00e9t\u00e9 employ\u00e9 comme ing\u00e9nieur en m\u00e9trologie pendant plus de 10 ans, l&rsquo;entreprise a arbitrairement chang\u00e9 son poste pour celui d&rsquo;ing\u00e9nieur qualit\u00e9 fournisseur en mai 2020, avec de nouvelles responsabilit\u00e9s. L&rsquo;entreprise a pr\u00e9tendu qu&rsquo;il s&rsquo;agissait de son propre d\u00e9veloppement et que sa charge de travail \u00e9tait trop l\u00e9g\u00e8re.<\/p><p>Il a \u00e9t\u00e9 contraint d&rsquo;accepter le poste, car la direction a indiqu\u00e9 que dans le cas contraire il devrait partir.<\/p><p>Le 10 mars 2021, la direction lui a adress\u00e9 \u00e0 la fois une premi\u00e8re et une deuxi\u00e8me lettre d&rsquo;avertissement, faisant \u00e9tat de prestations insuffisantes. M. Zulkarnain a \u00e9t\u00e9 licenci\u00e9 le 21 mai 2021, l&rsquo;entreprise affirmant que le dirigeant syndical \u00e9tait incapable d&rsquo;effectuer son travail.<\/p><p>La direction a menac\u00e9 M. Zulkarnain, lui enjoignant de ne pas faire appel du licenciement par l&rsquo;interm\u00e9diaire du syndicat, faute de quoi il ne recevrait que 50 % des indemnit\u00e9s pr\u00e9vues.<\/p><p>La FSPMI a d\u00e9pos\u00e9 une plainte aupr\u00e8s du D\u00e9partement du travail du district. PT Schneider Electric n&rsquo;a pas assist\u00e9 aux r\u00e9unions de m\u00e9diation du 1er et du 8 juillet. Le d\u00e9partement du travail du district a d\u00e9clar\u00e9 que le manque de performance ne pouvait pas \u00eatre un motif de licenciement.<\/p><p>Le Pr\u00e9sident de la FSPMI, Riden Hatam Aziz, a indiqu\u00e9&nbsp;:<\/p><blockquote><p>&ldquo;Ce licenciement chez PT Schneider Batam est clairement une pratique antisyndicale. Il s&rsquo;agit d&rsquo;une v\u00e9ritable menace pour les travailleurs et travailleuses qui doivent continuer \u00e0 se battre pour leurs droits fondamentaux sur le lieu de travail. Nous continuerons \u00e0 nous battre contre ce licenciement injuste et le soutien international \u00e0 cet \u00e9gard est absolument n\u00e9cessaire.&rdquo;<\/p><\/blockquote><p>Kan Matsuzaki, Directeur d&rsquo;IndustriALL pour les TIC, l&rsquo;\u00e9lectricit\u00e9 et l&rsquo;\u00e9lectronique, a d\u00e9clar\u00e9&nbsp;:<\/p><blockquote><p>&ldquo;Il n&rsquo;est pas acceptable que l&rsquo;entreprise intimide M. Zulkarnain. L&rsquo;attitude adopt\u00e9e par la direction est en contravention avec la Politique mondiale de lutte contre le harc\u00e8lement de l&rsquo;entreprise.&rdquo;<\/p><\/blockquote><p>Le Secr\u00e9taire g\u00e9n\u00e9ral d&rsquo;IndustriALL, Valter Sanches, <a href=\"\/wp-content\/uploads\/documents\/2021\/INDONESIA\/industriall_global_union_letter_to_schneider_electric_-_16.07.2021.pdf\">a \u00e9crit \u00e0 l&rsquo;entreprise<\/a> en d\u00e9clarant&nbsp;:<\/p><blockquote><p>&ldquo;Le licenciement de M. Zulkarnain constitue une pratique antisyndicale d\u00e9guis\u00e9e en transfert de poste.<\/p><p>La mise en garde contre la participation \u00e0 des activit\u00e9s syndicales constitue une violation flagrante du droit du travail indon\u00e9sien ainsi que des normes et crit\u00e8res internationaux en la mati\u00e8re.<\/p><p>Nous vous demandons instamment de mettre fin \u00e0 toutes les pratiques antisyndicales et d&rsquo;accepter la revendication de la FSPMI de r\u00e9int\u00e9grer imm\u00e9diatement M.
