Choi, un travailleur d&rsquo;un sous-traitant de l&rsquo;usine d&rsquo;Ulsan de Hyundai Motors en Cor&eacute;e du Sud, a &eacute;t&eacute; licenci&eacute; pour avoir men&eacute; des activit&eacute;s syndicales. M. Choi &eacute;tait employ&eacute; par le sous-traitant et affect&eacute; &agrave; l&rsquo;usine d&rsquo;Ulsan depuis mars 2002. <br \/>\n<br \/>\nLorsqu&rsquo;il a &eacute;t&eacute; licenci&eacute;, M. Choi a d&eacute;pos&eacute; une plainte administrative aupr&egrave;s de la Commission des Relations de Travail pour licenciement abusif en indiquant que Hyundai Motors &eacute;tait son employeur v&eacute;ritable et non pas l&rsquo;entreprise sous-traitante. <br \/>\n<br \/>\nLe 22 juillet 2010, la Cour Supr&ecirc;me de Cor&eacute;e a jug&eacute; que M. Choi avait &eacute;t&eacute; affect&eacute; de mani&egrave;re ill&eacute;gale et qu&rsquo;en r&eacute;alit&eacute; il &eacute;tait devenu un salari&eacute; direct de Hyundai au bout de deux ans et un jour de travail cons&eacute;cutifs. <\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" alt=\"\" src=\"\" width=\"250\" height=\"115\" \/><\/p>\n<p align=\"justify\">La Cour Supr&ecirc;me d&eacute;clare dans son jugement : &laquo; M. Choi &eacute;tait sous les ordres directs des ressources humaines de Hyundai Motors apr&egrave;s avoir &eacute;t&eacute; employ&eacute; par une de ses entreprises sous-traitantes. Il est donc estim&eacute; qu&rsquo;il &eacute;tait affect&eacute; aupr&egrave;s de Hyundai Motors. En vertu de la Loi sur la Protection des Travailleurs Affect&eacute;s, il doit &ecirc;tre consid&eacute;r&eacute; comme un travailleur employ&eacute; par Hyundai Motors au bout de deux ans et un jour de travail cons&eacute;cutifs. &raquo; <br \/>\n<br \/>\nLa F&eacute;d&eacute;ration cor&eacute;enne des m&eacute;tallurgistes a salu&eacute; la d&eacute;cision du tribunal et annonc&eacute; que &quot;ce jugement met un frein &agrave; la discrimination et &agrave; l&#8217;extorsion par les employeurs des travailleurs en situation irr&eacute;guli&egrave;re.
