Como consecuencia, el Zewu demand\u00f3 a Zesa en un tribunal penal por el incumplimiento. El fiscal adujo que Zesa se hab\u00eda negado deliberadamente a pagar a los trabajadores lo debido, afirmando que la compa\u00f1\u00eda hab\u00eda cometido un delito al contravenir la Ley del trabajo.<\/p><p>El magistrado dijo en su fallo: &ldquo;Hemos estimado que Zesa es culpable de incumplimiento de la SI 50 (registro del convenio colectivo) que le obligaba a pagar a los trabajadores aumentos salariales en 2012. Los cargos contra Zesa son abrumadores. Cuando se celebraban las negociaciones del convenio colectivo en 2012, Zesa era parte en la mesa y plenamente consciente de la creaci\u00f3n de SI 50. Con este hecho, y todos los dem\u00e1s presentados ante este honorable tribunal, el Estado ha demostrado m\u00e1s all\u00e1 de toda duda razonable la culpabilidad de Zesa.&rdquo;<\/p><p>El tribunal orden\u00f3 a Zesa que pagara una multa de 400 $ EE.UU., cumpliera el acuerdo y procediera a la restituci\u00f3n, exigiendo a Zesa que pagara a los trabajadores 60 millones $ EE.UU. de atrasos salariales, a falta de lo cual podr\u00eda haber embargo.<\/p><p>Tras la sentencia estall\u00f3 el j\u00fabilo entre los 3.000 trabajadores de Zesa. Comentando el fallo, la presidenta del Zewu, Angeline Chitambo, dijo: &ldquo;Esto es una gran lecci\u00f3n para los empleadores que obligan a los empleados a trabajar excesivamente y les pagan menos de lo debido &hellip;.la justicia ha prevalecido sobre las fuerzas del mal&rdquo;.<\/p><p>Chitambo fue <a href=\"http:\/\/www.industriall-union.org\/es\/la-presidenta-del-zewu-entre-los-135-trabajadores-suspendidos-en-zesa\">despedida injustamente<\/a> el a\u00f1o pasado por Zesa por supuestamente incitar a los trabajadores a la huelga a causa del incumplimiento por la compa\u00f1\u00eda del convenio colectivo.
